KUTATÁSI PROJEKT LEÍRÁSA

„A szerb és a magyar jog harmonizációja az Európai Unió jogával” című projekt keretében a terhelti vallomást, mint bizonyítási eszköz vizsgálatára került sor. A vizsgálat keretében rámutattunk arra, hogy a terhelt beismerő vallomásának kiemelt szerepe lehet az egyes külön eljárásokban, így a tárgyalás mellőzéses eljárásban, a bíróság elé állításos eljárásban és a tárgyalásról történő lemondásos eljárásban. Rámutattunk arra, hogy a magyar igazságszolgáltatás túlterheltsége szükségessé teszi a vizsgált eljárás gyorsítását, egyszerűsítését szolgáló külön eljárások létét.  Ugyanakkor e külön eljárások alkalmazási körének további törvényi bővítése, illetve bennük a terhelt beismerése jelentőségének bármilyen formában való fokozása átalakító hatással járhat az egész büntetőeljárásra.

The elementary legal requirement with respect to the confession of the defendant is, among others, its voluntary character. This includes the parallel analysis of: on the one hand that the testimony of the defendant was given without any (physical or mental) force; on the other hand that whether the confession is true or false in its content. Turning the thesis the other way around: the just content of the confession of the defendant, as well as its forceful obtaining can only be examined separately in „laboratory circumstances”.  Neither the unforced but false, nor the forced true confession can be accepted as the ground for a just judgement (at least not if the condition of the just judgement is to have the objective truth in a lawful proceeding).

Based on all the above-mentioned rises the question: what gives the extraordinary significance of the confession of the defendant as a means of evidence? When answering this question, our starting point is the well-known fact that the testimony of the defendant shall be regarded as a personal-type means of evidence, which compared to the object-type means of evidence (e.g.: deed) still enjoys preference. Certain evidence emanating from object-type means of evidence can only be regarded in themselves as „numb witnesses”, that is in our procedural law generally we need personal-type evidence in order to prove the significance and identity of the evidence emanating from the object-type means of evidence.  It originates from this that although the CPC lists the testimony of the defendant at the last place among the means of evidence, it shall not be underestimated, since the not too late confession can save many, generally superfluous procedural (primarily investigatory) actions; as well as no matter what kind of other evidence had been gathered during the criminal proceeding, those – in the eye of criminalistics – are crowned by the confession of the defendant, which might provide a thorough and all-explaining summary.
